O R D E R
By consent of both the learned counsel for the parties, the Writ Petition is taken up for final disposal, at the admission stage itself.
2. The instant writ petition has been filed directing the 1st respondent to release the result of the examination, which has been conducted pursuant to the Notification No.05/MRB/2025, dated 25.02.2025 and consequently, to 2/6
direct the 1st respondent to proceed with the selection process for the post of Assistant Surgeon (Dental) for 45 posts (excluding the 3 posts subject to interim injunction in W.P.(MD).No.14121 of 2025 without further delay.
3. Heard the learned counsel for both sides and perused the materials available on record.
4. The learned Senior Counsel appearing for the petitioner would fairly submit that there is also a stay by the learned Single Judge of this Court in W.M.P.(MD).No.10256 of 2025 in W.P.(MD).No.14121 of 2025, dated 14.05.2025. However, it is the contention of the learned Senior Counsel for the petitioner that the interim order is only against the reservation in respect of the Ex-Servicemen and there is no impediment for the 1st respondent to release the result.
5. The above said contention was objected by the learned Standing Counsel appearing for the 1st respondent and learned Standing Counsel appearing for the 4th respondent.
3/6
6. I have given my anxious consideration to the submissions made on either side.
7. While looking at the order of the learned Single Judge dated 14.05.2025, an order of interim injunction was granted. For ready reference, the same is extracted hereunder:- "Since there is no reservation for the Ex-Servicemen as per the Rules in the Notification No.05/MRB/2025, dated 25.02.2025, issued by the Medical Service Recruitment Board, there shall be an order of interim injunction. Notice."
8. It is the contention of the learned Senior Counsel for the petitioner that it operates only against the Ex-Servicemen. This Court cannot proceed on that submission, unless the petitioner moves before the learned Single Judge in this regard.
9. In view of the injunction granted by the learned Single Judge in W.M.P.(MD).No.10256 of 2025 in W.P.(MD).No.14121 of 2025, dated 14.05.2025, this Court is not in a position to direct the 1st respondent to release the result.

10. Hence, the Writ Petition is dismissed. However, the petitioner is given liberty to approach the learned Single Judge in this regard. No costs. 17.07.2025 Index : Yes/No Speaking order /Non Speaking Order dm Note: Issue order copy today (i.e., 17.07.2025).
