Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus to call for the records connected with the impugned order dated 05.07.2019 issued by the 1st respondent vide Proceedings No.2481-1/Estt(per)/A5/2019 and quash the same and further direct the 1st respondent to refix the petitioner's seniority in the post of Assistant Engineer and Assistant Executive Engineer as per TWAD Board Service Regulations, 1972 (amended in B.P.Ms.No.140 dated 06.12.2007) duly following Rules of Reservation and to include his name in the panel of Assistant Executive Engineer fit for promotion to the post of Executive Engineer for the year 2017-2018 as well as 2018-2019 and to 1/5
promote him as Executive Engineer duly assigning correct seniority and permitting him to draw arrears of pay and allowances accrued thereto retrospectively on par with his junior on merits and in accordance with the law within a time frame as fixed by this Court. Heard the learned counsel for the petitioner and the learned Senior counsel appearing for the respondents and perused the materials available on record.

The petitioner by the present writ petition had sought for fixing the petitioner's seniority in the post of Assistant Engineer and Assistant Executive Engineer as per TWAD Board Service Regulations, 1972, duly following the Rules of Reservation and to include his name in the panel of Assistant Executive Engineer, fit for promotion to the post of Executive Engineer for the year 2017-2018 as well as 2018-2019 and to promote him as Executive Engineer duly assigning correct seniority and permitting him to draw arrears of pay and allowances accrued thereto retrospectively on par with his junior.

Today, when the writ petition is taken up for hearing, it is brought to the notice of this Court by the learned Senior Counsel appearing for the respondents that the Co-ordinate Bench of this Court in W.P.No.25158 of 2012 vide order dated 08.08.2024 had rejected the claim of the petitioner who requested to regularize his service in the post of 'Technical Assistant' from the date of his initial appointment and also place him in appropriate serial number in the order of seniority list in the post of 'Assistant Engineer'.
4. Since, the claim of the petitioner for placing him in appropriate serial number in the order of seniority list in the post of 'Assistant Engineer' having been rejected by this Court in W.P.No.25158 of 2012, the petitioner cannot claim further seniority in the post of 'Assistant Engineer'.
5. Thus, this Court is of the view that the claim of the petitioner in the present writ petition is without merit. Accordingly, the writ petition is dismissed. No costs. Consequently connected miscellaneous petitions are closed.
