This Writ petition is filed to issue a Writ of Mandamus, directing the respondents to consider the petitioner's representation dated 26.07.2021 & 15.10.2021.
2. The grievance of the petitioner is that one Dharmichand, his wife Indira and their son Deepak and Ajajai cheated him by selling his land without his knowledge and when the same was questioned by him, they threatened him with dire
consequences. There are 12 Civil Suits pending against them for recovery of possession and four criminal cases also filed against them. Since there are so many FIRs pending against them, he made a representation to the respondents 1 to 3 to detain them under the Goondas Act. The petitioner's representation was not considered, hence, the present petition.
3. The learned Additional Public Prosecutor submits that the petitioner is not an innocent person and he is involved in job racketing. The petitioner by giving false promise to several persons to secure jobs in the Judiciary as well as the Forest Department, cheated amount to the tune of Rs.4.67 crores. Hence, a case has been registered against him in Crime No.21 of 2021 for the offence under Sections 406, 465, 468, 471, 420 and 506(ii) of IPC. He further submits that the petitioner has got personal enmity with the said AGS Jewellers, Dharmachand and his family, hence, he made the complaint.
4. In view of the above, it is seen that the petitioner is not a person with clean hands and he himself got involved in job racketing cases and cheated several persons to the tune of Rs.4.67 crores on the promise of getting employment in the Judiciary and Forest Department. Hence, this Court is not inclined to entertain this petition.
5. Accordingly, this Writ Petition is dismissed. No costs.
