respondents to consider the petitioner representation dated 23.06.2025 to the 3rd respondent herein to take appropriate action and direct the 3rd respondent to pass appropriate direction and restrain the respondent 4 and 5 from plying vehicle TN45-N-4369 or any other bus or vehicle bearing any other registration number carrying passenger without any route permit in the route of Trichy to Veeraganur via Perambalur and pass necessary and appropriate orders or direction at the earliest within a time frame fixed by this Court.

O R D E R

The writ petition is filed for a direction to the 3rd respondent to restrain the respondents 4 & 5 from plying vehicle bearing TN45-N-4369 as any other vehicle, on route Trichy to Veeraganur via Perambalur on the basis of the petitioner's representation dated 23.06.2025.

2. The petitioner is a stage carrier operator, operating in the name and style of "SKM Transports". The petitioner possesses route permit in and out of Perambalur. The petitioner states that the Vehicle bearing Registration No.TN46-N-4369, belonging to the respondents 4 and 5 was 2/5

unauthorisedly plying on route Trichy to Veeranganur via Perambalur though holding the route permit from Trichy to Chennai. The petitioner states that because of the unauthorised plying of the said vehicle, the petitioner and other private operators suffered losses. Therefore, the petitioner submitted a representation on 23.06.2025 to the third respondent to initiate action against the respondents 4 and 5. As no action was taken, the petitioner was constrained to file the above writ petition.

3. Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondents 1 to 3 and perused the materials available on record. With consent of both parties, this writ petition is taken up for final disposal.

4. Under the facts and circumstances of the case, this Court is of the view that it would suffice to direct the 3rd respondent, to consider the petitioner's representation dated 23.06.2025, on merits and in accordance with law within a period of four weeks from the date of receipt of a copy of this order and take appropriate action, if necessary. It is made clear that the petitioner as well as the 4th and 5th respondents shall be afforded an opportunity of hearing, while considering the petitioner's representation. 3/5
