This application has been filed to condone the delay of 251 days in filing the counter-statement to the Election Petition.

2. In the affidavit filed in support of the Judges Summons, it had been stated that the applicant had filed an application to reject the Election Petition, which was dismissed on 21.04.2025 and thereafter, he had challenged that order before the Hon'ble Supreme Court in S.L.P. (Civil) No. 18726 of 2025. However, the same was also dismissed by the Hon'ble Supreme Court by order dated 21.07.2025. Thereafter, instructions had to be given to prepare the counter-statement and in that process, there has been a delay, which have been calculated from the date of the issue of the initial summons.

3. Heard the learned counsel for the respondent also.

4. In view of the fact that it would always be advisable and prudent that the issues raised in the Election Petition are examined on the basis of the contentions raised by all the parties to the petition, the delay is condoned and the original application stands allowed.
