ORDER

The petitioner challenges the order of rejection of the plaint under Order VII Rule 11(d) of CPC as one barred by law. Though it is by way of docket order, however the rejection of the plaint amounts to a decree which is appealable under the provisions of CPC. Hence, I am not inclined to entertain the revision petition under Article 227 of Constitution of India. Liberty is granted to the petitioner to prefer a regular first appeal as against the said rejection.

2. The Registry is directed to return the original papers enabling the petitioner to move the appeal before the Appellate Court.
