This Court by an Order dated 18.01.2019, had directed the learned Additional District and Sessions Judge, Cuddalore, to complete the proceedings in S.C.No.164 of 2016, within a period of four months from the date of receipt of a copy of that order. 2.

Now the learned Additional District and Sessions Judge, Cuddalore has requested this Court to grant further period of four months to dispose of the aforesaid proceedings, as directed by this Court.

3. On going through the report, it is found that the accused persons are absenting themselves in turns. If the accused persons are adopting dilatory tactics, it is open to the Court below to insist for their presence and remand them to custody as laid down by the Hon'ble Supreme Court in State of Uttar Pradesh Vs. Shambhu Nath Singh and Ors. reported in JT 2001 (4) SC 319. The Court below should not stand helpless and it is expected to be proactive in ensuring the presence of the accused and completing the trial within the time fixed by the Court.

vs/jas a period of four months from today. It is made clear that no further extension of time will be granted by this Court and the learned Additional District and Sessions Judge, Cuddalore, is directed to file a compliance report immediately after the completion of the proceedings.
