This petition has been filed to condone the delay of 110 days in filing a petition to restore the W.M.P.No.29107 of 2017 in W.P.No.27257 of 2017 which has been dismissed for default on 28.01.2022.

2. The learned counsel for the petitioner submit that due to the erstwhile Founding Trustees were not diligently following up the matter, the writ petition and the present miscellaneous petition have been dismissed for default. After the petitioner Trust came under the management and control of the new Trustees on 10.08.2002, they came to know about the dismissal of the writ petition. Hence, the delay has occurred and the same is neither wilful nor wanton and prayed to allow this petition.

3. Having regard to the reasons stated in the affidavit filed along with this petition and taking note of the facts and circumstances of the case, this petition is Ordered and the delay is condoned. 23.09.2022 vrc Note : The registry is directed to number the WMP filed to restore, if it is otherwise in Order and post before this Court on 17.10.2022 https://www.mhc.tn.gov.in/judis
