Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the third respondent herein to consider the petitioner's representation dated 24.04.2024 sent for cancellation 1/6

of patta bearing No.62 issued in the name of late Madurai Muthu Pillai and to issue a Joint patta consisting the names of Madurai Muthu Pillai and Murugesa Pillai in respect of the lands in S.F.No.99/2 measuring 0.75.50 Hectares situate in Nerkundram Village, Uthiramerur Taluk, Kanchipuram District, within a stipulated period.

The petitioner herein seeks a direction to the third respondent herein to consider the petitioner's representation dated 24.04.2024 seeking cancellation of the patta No.62, exclusively issued in the name of Madurai Muthu Pillai father of the fourth respondent and to issue joint patta in the name of Madurai Muthu Pillai and the petitioner's father in respect of the land in S.F.No.99/2 measuring 0.75.50 Hectares, situated in Nerkundram Village, Uthiramerur Taluk, Kanchipuram District.

2. According to the petitioner, the above said land originally belonged to him and patta was issued in the name of the petitioner's father Murugesa Pillai and fourth respondent's father viz., Madurai Muthu Pillai. During reclassification of land, Natham patta was wrongly issued in the name of the fourth respondent's father exclusively. Therefore, the petitioner submitted a representation on 24.04.2024 seeking cancellation of patta issued in the name of the fourth respondent's father and issue a joint patta and the same has not been considered. Therefore, the petitioner is before this Court.

3. Mr. A.Selvendran, learned Special Government Pleader, who takes notice for the respondents 1 to 3 would submit that the representation of the petitioner dated 24.04.2024 will be considered on its own merits, within a time framed fixed by this Court.

4. In view of the same, without going into the merits of the claim made by the petitioner, this Court is inclined to issue a direction to the third respondent to consider the representation of the petitioner dated 24.04.2024 3/6

and pass final orders, on its own merits, within a period of 8 weeks from the date of receipt of copy of this order, after issuing necessary notice to the respondents 4 & 5.

5. With the above direction, this Writ Petition is disposed of. No costs.
