Heard the learned counsel appearing for the petitioner, learned Government Advocate (Crl.Side) appearing for the respondents 1 to 3 and the learned counsel for the respondents 4 and 5 and perused the documents placed on record.
2. The grievance of the petitioner is that 102 sq.mtrs of petitioner's land was taken up by the Government for laying road and in exchange of that land, an extent of 222 sq.meters of the government land has been allotted to the petitioner. In this regard, proceedings have been passed by the Government and the Revenue records were also changed. Further, the land, which was taken from the petitioner has been used as road.
The land allotted to the petitioner was surveyed, however while fixing stones, there was an objection from the other side. However, the learned counsel for the respondents 4 and 5 would submit that if their were land is also being surveyed, there would be no difficulty.
3. Admittedly, the petitioner's land appears to have taken by the Page 2 / 4
Government and in view of the same, 222 sq.meters of the land has been earmarked and given to the petitioner. In such view of the matter, the police officials shall seek the help of revenue officials and see that survey is done in their presence so that quietus can be given and such exercise shall be completed within a period of two months from the date of receipt of copy of this order.
