Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India seeking a writ of certiorarified mandamus to call for the records pertaining to the order dated 30.03.2016 of the fourth respondent herein made in proceedings No.P.VIII.2/2015.Estt.2 imposing the punishable of compulsory retirement with the penalty of reduction of 1/3rd of pension which is entitled in the case of normal pension admissible to the petitioner and quash the same and direct the respondents to reinstate him in service with all monetary benefits and backwages.

By way of filing this writ petition, the petitioner seeks to quash the impugned proceedings dated 30.03.2016 passed by the fourth respondent / the DIGP/the Principal, Recruit Training Centre, Chennai, imposing the punishment of compulsory retirement with penalty of reduction of 1/3rd of pension.
2. When the matter is taken up, learned counsel for the petitioner has produced a copy of the proceedings dated Nil-032017 passed by the third respondent, wherein it is seen that the third respondent has modified the impugned punishment of compulsory retirement with penalty of reduction of 1/3rd of pension into that of compulsory retirement with 100% pension benefit from the date of compulsory retirement i.e. 30.03.2016. In view of such modification order, learned counsel for the petitioner, without pressing for the remaining prayer of reinstatement, sought for closing the writ petition.
3. Recording the above said proceedings and also the submission of the learned counsel for the petitioner, the writ petition is closed. No Costs. WMP.No.28203 of 2016 is closed.
