ORDER

This Criminal Original Petition has been filed to set aside the order dated 19.04.2017 passed in C.M.P.No. 2001 of 2017 in C.C.No.441 of 2006 on the file of Judicial Magistrate No.II, Salem.

2. Today, when the matter was taken up for hearing, the learned counsel for the respondent appearing for the respondent, on instructions, submitted that there was some money dispute arose between the petitioner and the respondent. The defacto complainat filed a complaint under Section 138 and 142 of the Negotiable Instruments Act, r/w Section 200 of CrPC against the petitioner/accused in C.C.No.441 of 2006, was pending before the learned Judicial Magistrate-II, Salem. After mutual discussion between the parties, the entire issues have already been settled before the Court below. Therefore, the relief sought for by the petitioner has become infructuous.

3. In view of the above submission made by the learned counsel for the respondent, nothing survives for further adjudication in this petition, hence, the Criminal Original Petition is closed. Consequently, connected Criminal Miscellaneous Petitions are also closed.
