At the instance of the learned counsel for the petitioners, the matter has been listed today under the caption 'For being mentioned'. 2.The learned counsel appearing for the petitioners submitted that in the final order passed by this Court on 09.12.2021 in Crl.O.P.No.23205 of 2021, in the sixth and seventh paragraphs, it has been mentioned as "6. On the submission of the learned counsel appearing on either side and also on perusal of materials available on record, the respondents calling the petitioners to appear with relevant documents to show jewels recovered following Pawn Brokers Act, if credible information is available to show that the petitioners received any stolen articles, appropriate steps to be taken. Thus Issuance of summons and calling for enquiry cannot be termed as harassment.
7. In view of the same,this Criminal Original Petition is dismissed.", and prays that the same may be modified in the order. 1/4
3.Heard Mr.E.Raj Thilak, learned Additional Public Prosecutor for the respondents and he submits that the order may be modified. 4.Considering the submission made by the learned counsel appearing for the petitioners and the learned Additional Public Prosecutor appearing on behalf of the respondents, the sixth and seventh paragraphs of the order dated 09.12.2021 in the above Criminal Original Petition shall be read as follows:
"6. On the submission of the learned counsel appearing on either side and also on perusal of materials available on record, the respondents shall issue summons, calling the petitioners to appear with relevant documents to show jewels recovered following Pawn Brokers Act, if credible information is available to show that the petitioners received any stolen articles, appropriate steps to be taken. 7. In view of the same,this Criminal Original Petition is closed."
5.Registry is directed to issue the fresh order copy after incorporating the necessary corrections in the above said order dated 09.12.2021.
