Considering the part of action arisen within the jurisdiction of this Court and the fact that the 4th defendant is residing outside the jurisdiction of this Court and the property subject matter of the suit is situate outside the jurisdiction of this Court, this application is allowed granting leave the plaintiff to institute the suit as against the 4th defendant in this Court.
