Writ Petition filed under Article 226 of the Constitution of India to issue Writ of Mandamus, directing the respondents to consider the petitioner's representation dated 02.11.2023 and allot a Plot at M.K.B. Nagar, Ambattur, Chennai - 600 053 as per the receipt dated 13.11.1993 issued by the second respondent.

ORDER

The petitioner has come up with this writ petition seeking Writ of Mandamus, to consider the petitioner's representation dated 02.11.2023 and allot a Plot at M.K.B. Nagar, Ambattur, Chennai - 600 053 as per the receipt dated 13.11.1993 issued by the second respondent. 1/4

2. It is the case of the petitioner that originally, as per the eligibility list, his father was an allottee of Housing Board Plot at the aforesaid location. It is further stated that the petitioner is having receipt, dated 13.11.1993 as proof for payment of Rs.750/- towards the said allotment. Earlier, he filed writ petition viz., W.P. No.35178 of 2023 before this Court for issuance of appropriate directions in the above regard. This Court, vide order dated 02.04.2024, dismissed the said petition by granting liberty to the petitioner to make fresh application before the respondents. Subsequently, he made representation to the respondents seeking for allotment of the plot in his favour at the aforesaid place, which has not evoked any response till date, which prompted filing the present writ petition.

3. Learned counsel for the petitioner submits that it would suffice, if this Court directs the respondents to consider the representation of the petitioner for allotment of the plot to the petitioner, within a time frame that may be fixed by this Court.

4. The learned counsel for the respondents has no objection for said order being passed.

5. In view of the aforesaid submissions, this Court without expressing any opinion on the merits of the case, directs the respondents to 2/4

consider the petitioner's representation, lastly dated 01.05.2024 and pass orders on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.

6. With the above direction, this writ petition is disposed of. No costs.
