..Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the 1st and 2nd respondents to give the adequate Police protection to measure the petitioner's land and also to put up fencing the land situates in Punsei S.No.184/3C, Hecter 1.06.50 or 2.63 Acres of land situated at Kadamadai village, Pennagram Union and Taluk, Dharmapuri District by considering the petitioner's representation, dated 18.05.2023.

ORDER

This Writ Petition has been filed for a direction to the respondent Police to give Police protection to the petitioner in order to enable the petitioner to fence his property based on the representation, dated 18.05.2023.

2. The learned Additional Public Prosecutor, on instructions, submitted that earlier, a complaint was given before the Pennagaram Police Station and it was enquired in C.P.No.0095 of 2023 and it was closed. It is further submitted that the jurisdictional Police is the second respondent and hence, if the petitioner gives a complaint in person before the second respondent, the same will be dealt with in accordance with law.

3. In the light of the above submission, there shall be a direction to the petitioner to give a complaint before the second respondent in person and the second respondent shall deal with the same on its own merits and in 2/4

accordance with law and shall enquire the parties and take a decision within a period of four weeks from the date of receipt of the complaint from the petitioner.

4. This Writ Petition is disposed off with the above directions. No costs.
