O R D E R

This petition has been filed by the petitioner to call for the records pertaining to the order passed by the 2nd respondent bearing no NA.KA.EN:60/VU.KAA.KA.SITHAM/2017, dated 24.12.2017 and to set aside the same pursuant to the petitioner's representation dated 19.11.2021.

2. The grievance of the petitioner is that the police official attached to the respondents 1 and 2 are continuously disturbing the petitioner by asking him to appear before the police station for execution of bond in the light of second respondent's order dated 24.12.2017, permitting the third respondent open history sheet against the petitioner. Further, he made representation to the respondents 1 and 2 on 18.11.2021 to remove his name from the register of history sheet but no action has been taken. It is further stated that all the cases registered against him is only due to political motive and due to the history sheet register maintained against him, his fundamental and legal rights have been severely affected and the same also results in social stigma. The learned counsel appearing for the petitioner submitted that History Sheet is only period of one year, unless it has been periodically renewed on the requisition of the Superintendent of Police.

The learned Additional Public Prosecutor appearing for the petitioner submitted that against the petitioner there was 13 cases of which some cases ended in acquittal and some cases further action was dropped and four cases are pending against the petitioner out of them one case is pending investigation and the other cases are in trial stage. He further submitted that in this case, the Petitioner's History Sheet has not been renewed and the order passed on 24.12.2017 already lapsed.

4. Recording the submissions of the learned Additional Public Prosecutor to that effect that the History Sheet pertaining to the petitioner already lapsed and the petitioner's name no more listed in the History Sheet, no order is required to be passed in this Criminal Original Petition. In view of the same, this Criminal Original Petition is disposed.
