ORDER
This writ petition has been filed for the issue of a writ of mandamus directing the first Respondent to pass orders in the pending RC No.12523/12/B4/KPM, dated 15.09.2022 and 29.09.2022 within the time frame fixed by this Court.
2. The case of the petitioner is that the subject property originally belonged to the petitioner's husband and his brothers. They lawfully partitioned the property among themselves. Thereafter, the petitioner became entitled to the property, and the documents, including revenue records, stand in her name. In the year 2006, the Second Respondent was granted temporary permission to use the portion of the vacant land. However, he colluded with the Executive Officer and registered the property fraudulently, as if it is a Wakf property under Section 32 of the Wakf Act, 1995. The petitioner gave a criminal complaint which was taken on file in FIR.No.423 of 2013. That apart, the petitioner also gave a complaint before the First Respondent, and since the same was not acted upon, this present writ petition came to be filed.
3. Taking note of the facts and circumstances of the case and considering the grievance expressed by the petitioner, there shall be a direction to the First
Respondent to enquire upon the pending RC No.12523/12/B4/KPM, dated 15.09.2022 and 29.09.2022 after affording an opportunity to the Second Respondent and take a final decision within a period of eight weeks from the date of receipt of a copy of this order.
