JUDGMENT

The appellant, who was found guilty and convicted by the learned Special Judge for the Cases under Prevention of Corruption Act at Chennai for the offences punishable under Sections 120-B, 167, 409, 467, 468, 471 IPC and 13(2) read with 13(1)(c)&(d) of Prevention of Corruption Act, 1988, in C.C.No.140 of 2011 (Old No.11/2008) vide order dated 29.04.2017, has filed the present Criminal Appeal .

2. Mr.C.S.Dhanasekaran, learned counsel for the appellant submitted that the appellant has passed away on 07.02.2019. He further submitted that he has been instructed by the legal heir of the deceased appellant that she is not interested in pursuing the appeal and she has also given a letter dated 07.11.2023 to that effect. Further, pursuant to the order passed by this Court on 20.10.2023, the learned counsel for the appellant has also filed a Memo along with the Appellant's Death Certificate and the letter given by the legal heir of the deceased appellant dated 07.11.2023, before this Court. 2/4

3. Recording the submissions made by the learned counsel for the appellant and taking note of the Memo filed by the appellant's counsel, this Criminal Appeal stands dismissed as abated.
