Crl.O.P.Nos.27477 and 27481 of 2019 and Crl.A.SR.Nos.33825 and 33824 of 2018 A.D.JAGADISH CHANDIRA, J., These above Criminal Original Petitions have been filed by the petitioners/appellants, seeking to grant leave to the petitioners to prefer the above criminal appeals as against the order of acquittal dated 10.04.2019, in Crl.A.Nos.71 and 70 of 2018, on the file of the learned II Additional Sessions Judge, Vellore @ Tirupattur, reversing the judgment dated 23.03.2018, made in STC.No.1 and 15 of 2016, on the file of the Judicial Magistrate No.III, Tirupattur.
Heard the learned counsel for the appellant.
The learned counsel for the petitioners would submit that the trial Court has convicted the accused on a finding that the appellants have proved the offences against the accused. However, the Appellate Court, on wrong consideration and appreciation of law and facts, had held that the respondent/accused had rebutted the presumption and had acquitted the accused.
