COMMON JUDGMENT (The Judgment of the Court was delivered by T.RAJA, J) When the matter was taken up for hearing, the learned counsel appearing for the appellant fairly submitted that the fifth respondent/students, who studied in the appellant School, on completion of their Course and after receiving Transfer Certificate, had left the School. Therefore, the question of collecting Management fees from them is far from acceptance.
2. Secondly, the learned Single Judge, in the operative portion of the order, dated 04.06.2019, in paragraph 11 (4), has held that if the management of the fourth respondent School is not submitting any Financial Statement (Expenditure) as required by the authorities concerned and the fourth respondent School still is not allowing the Officials to audit the records of the fourth respondent School, the management of fourth respondent School is not entitled to claim management fee for any of its students from the academic year 2018-2019 onwards. In compliance of the same, the authorities had conducted audit in the appellant School for the years between 2005-06 and 2018-09 and a letter, dated 18.08.2020 has been placed before this Court to that effect.
