This petition has been filed to direct the respondents to include Section 307 of I.P.C. in Cr.No.374/2017 on the file of the 2nd respondent also file a charge sheet within stipulated period prescribed by this Court.

2.The learned Additional Public Prosecutor on instructions submitted that the investigation has been completed and the final report has been filed in C.C.No.3028 of 2017 before the X th Metropolitan Magistrate Court, Egmore, Chennai and it is at the stage of trial. In the course of proceedings, the Trial Court can always add any offence based on the materials collected during trial, by virtue of its power under Section 216 of Cr.P.C.
