This Civil Miscellaneous Petition has been filed seeking to condone the delay of 70 days in filing the above Review Application.

2. Mr. V.Sekar, learned counsel for petitioner submitted that due to ill-health of petitioner, he is unable to travel to Chennai and after recovering from his illness, he contacted his counsel and came to know the fact of dismissal of Second Appeal. Now he has filed the above Review Application to review the order. However, there is a delay of 70 days arose and the delay is neither willful nor wanton. Hence, he has filed the above petition.

3. Mrs.R.Meenal, learned counsel for 1st respondent appeared and raised formal objections in allowing this petition.

4. Considering the facts and circumstances, and being satisfied with the reasons assigned in the affidavit, this petition allowed.

5. Registry is directed to number the review application if it is otherwise found to be in order and and post the matter on 19.09.2023. 30.08.2023 rpp https://www.mhc.tn.gov.in/judis
