ORDER
This Criminal Original Petition has been filed to transfer the investigation in Crime No.322 of 2021 from the third respondent police to the fourth respondent.
2. It is the case of the petitioner that he is the father of the deceased. According to him, his daughter was subjected to dowry harassment which resulted in her death on 23.02.2021. Thereafter, the First Information Report
came to be registered in Crime No.322 of 2021. According to the petitioner, during the trial the third respondent did not produce the witnesses before the trial Court properly. Further, the petitioner has also informed about the involvement of the sister of the accused in the crime. However, the police has not considered the same and included her as an accused. Even during the enquiry before the Revenue Divisional Officer, he has deposed about the death of his daughter and it is not a suicide and several situations to prove that the incident was a murder. Therefore, he seeks to transfer the investigation.
3. At the outset, this Court is of the view that the petition filed by the petitioner is nothing but abuse of process of law for some other reasons. Admittedly, the case is of the year 2000 and final report has been filed as early in the year 2023 and in the postmortem certificate it is clearly opined that it is a case of suicide. Even the case of the petitioner and others is that the daughter of the petitioner committed suicide due to dowry harassment. Now the petitioner is trying to convert the case as that of a homicidal death, particularly, when no objection whatsoever has been raised at any point of time.
4. It is relevant to note that the petitioner has already been examined before the trial Court. If really his stand that police has not properly enquired the case, he could have given evidence before the trial Court. In that case, the trial Court has jurisdiction to add new accused also. Having subjected himself to cross examination and almost 14 witnesses have been examined, at this stage, seeking reinvestigation is only for some other reason and motivation. Hence, I do not find any merits in this petition.
