Prayer :- Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the third respondent to implement the letter No.165/2017/D1 dated 17.11.2017 from the fourth respondent and correct the extent of the petitioner land in the patta No.708 Punjai Kolanalli 'B' Village, Kodumudi Taluk, Erode District.

ORDER

This writ petition is filed for direction directing the third respondent to implement the letter No.165/2017/D1 dated 17.11.2017 from the fourth respondent and correct the extent of the petitioner's land in the patta No.708 Punjai Kolanalli 'B' Village, Kodumudi Taluk, Erode District.

2. Heard, Mr.K.Karthikeyan, the learned counsel for the petitioner, and Mr.V.Jeevagiridharan, learned Additional Government Pleader appearing for the respondents.

3. The case of the petitioner is that the petitioner owned ancenstral property in Punjai Kolanalli 'B' Village in patta No.708 admeasuring 4.65.00 hectares. Earlier, the petitioner obtained computerised patta and the extent of the land was correctly mentioned in the same. However, after six months, when the petitioner had taken computerised patta, the petitioner came to understand that the extent of the land reduced in survey no.545/1 to an extent of 1.32.50 instead of 1.39.50 and in survey No.559/2, 0.4.00 instead of 0.6.50, in total 0.9.50 hectares reduced by the revenue authorities without any notice to the petitioner. Therefore, the petitioner submitted representations on 24.10.2016, 23.01.2017 and 18.05.2017 and the same was forwarded to the third respondent by the fourth respondent.

Considering the same, the third respondent is directed to conduct enquiry on the representations of the petitioner dated 24.10.2016, 23.01.2017 and 18.05.2017 and, after issuing notice to the counter parties, if any, and giving them opportunity of hearing, pass orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of copy of this order.

5. With the above direction, this writ petition is disposed of. No order as to costs.
