C.M.P.No.19310 of 2019 in C.M.A.SR.No.109086 of 2019 R.MAHADEVAN, J.

Learned counsel for the second respondent Insurance Company has no objection in allowing this petition.

Considering the reasons stated in the affidavit filed in support of this petition, this petition is allowed and the delay of 1020 days in filing the above appeal is condoned, subject to the condition that the petitioner / appellant pays a sum of Rs.1000/- (Rupees One Thousand Only) as cost, to the Tamil Nadu State Legal Services Authority, High Court Campus, Chennai-104, within a period of two weeks from today, failing which this petition shall stand dismissed automatically.

2.It is made clear that in the event of succeeding in the appeal, the petitioner / appellant will not be entitled for interest for the said delayed period in respect of the enhanced amount of compensation. It is also made clear that the petitioner / appellant shall take fresh notice to the first respondent privately forthwith, indicating that the main appeal would be taken up by this Court for admission.

3.Registry is directed to number and list the appeal printing the name of the counsel Mr.J.Chandran for the second respondent, if the same is otherwise in order, after two weeks.
