This petition has been filed seeking to call for the records and set aside the order in Crl.M.P.No.267 of 2017 in S.T.C.No.901 of 2012 dated 16.02.2017 on the file of the Judicial Magistrate No.1, Mannargudi and direct the respondent to recall the P.W.1 for cross examination.

2. It is seen that when this case was taken up for hearing on 12.04.2017, for admission, there is no representation for the petitioner. Therefore, this Court adjourned the matter to 17.04.2017. Today, when the matter came up for hearing, there is no representation on behalf of the petitioner. It shows that the petitioner is not interested to pursue the matter further. Learned counsel for the petitioner did not taken any steps to list the matter even for admission and hence, it is still pending at the admission stage itself from the year 2017. Therefore, this Court is not inclined to entertain this petition.

3. Accordingly, this Criminal Original Petition is dismissed. Consequently, connected miscellaneous petition is closed.
