Heard the learned counsel for the petitioner and the learned counsel for the 2nd respondent.

2. Learned counsel for the petitioner would aver that on account of the accident that took place on 02.08.2012, his son suffered a head injury and had been under continuous treatment. Thereafter, due to financial constraints, the petitioner was not in a position to arrange the Court fee to prefer the appeal. 3.Mr.J.Chandran, learned counsel for the 2nd respondent /Insurance Company takes notice for the 2nd respondent. He would submit that he does not have any serious objection in allowing the above petition.

4.Accepting the averments made by the petitioners in the affidavit enclosed with the petition, this Court is inclined to allow this Civil Miscellaneous Petition subject to the condition that the interest for the delay period of 753 days shall stand waived. Accordingly, this Civil Miscellaneous Petition is ordered. 5.Registry is directed to number the above C.M.A.SR.No.108243 of 2024 and post it for Admission in regular course, if the papers are otherwise in order.
