This petition has been filed to set aside the order passed in C.M.P.No.3213 of 2017 in M.C.No.5 of 2014 dated 29.08.2017 on the file of the Judicial Magistrate No.1 at Sankari, Salem District by allowing the present Criminal Original Petition.

2. The learned Additional Public Prosecutor submitted that the respondent is a wife of the petitioner and she has filed maintenance petition in M.C.No.05/2014, that was already disposed by the Judicial Magistrate No.1, Sankari, during the year 2017.

3. In view of the above submission, nothing survives for adjudication in this petition. Therefore, the Criminal Original Petition is dismissed as infructuous. No costs. Consequently, connected miscellaneous petition is closed.
