The petitioner namely N.Ramesh, who was arrested and remanded to judicial custody on 17.05.2023 for the offences punishable under Sections 419, 420, 147, 120(B), 170, 171, 342, 364, 395 of IPC in Crime No.48 of 2023 on the file of the respondent police, seeks bail.

The learned counsel for the petitioner submitted that, petitioner is innocent and he is falsely implicated in this case registered in Crime No.48 of 2023 for the offences under Sections 419, 420, 147, 120(B), 170, 171, 342, 364, 395 of IPC. Petitioner is in judicial custody from 17.05.2023. Thus, he prays for grant of bail.

3. Learned Additional Public Prosecutor opposes this petition, on the ground that, this is a case of doubling the money. The accused in this case, especially accused Natarajan and Ramesh, promised the defacto complainant that, if he gives the accused 500 rupee currency notes, they will pay double the amount in 2000 rupee currency notes, Believing the words of the accused, defacto complainant arranged Rs.15,00,000/- and kept it in a car bearing No.TN 19 AQ 1207 I-20 and contacted Jayaraj. Jayaraj informed him that, he has 1/4

spoken to Nataraj and Ramesh and asked the defacto complainant to come to Vellore at about 5.00 p.m., on 04.06.2023. As per the direction, defacto complainant, Kathir Moideen and Jayaraj proceed in the aforesaid car to Vellore and waited near Namma Veedu Hotel. At about 6.00 p.m., Ramesh came there and asked Jayaraj, how much money he got. Defacto complainant replied that, he brought Rs.15,00,000/-. After showing the money, Ramesh got into their car and he asked the defacto complainant to drive the car to a specific place. When the car reached near Vellore, Sathuperi Erikarai Service Road, Ramesh asked to stop the car. At that time, 3 persons came there in a Car bearing No.TN 07 CD 5991 MARUTI SUZUKI SCROSS and stopped in front of them and an INNOVA car stopped behind their car.

One person wearing police uniform, asked them to get into the INNOVA car. They took Rs.15,00,000/- from the defacto complainant's car. They had taken Kathir Moideen in INNOVA car and Jayaraj in a SUZUKI SCROSS car and dropped them at a distance. In such circumstances, this case came to be filed. Only 8 accused were arrested and 4 are absconding. Out of Rs.15,00,000/-, no amount is recovered so far. Investigation in this case is not completed. Therefore, he prays for dismissal of this bail petition.

It is seen from the FIR allegations that, petitioner is the main accused who introduced the defacto complainant to part with the money and he along with other accused had actively involved in exchanging the money. Still some of the accused are absconding in this case and the amount involved in this case ie., Rs.15,00,000/- is not yet recovered and the investigation in this case is pending. Therefore, this Court is not inclined to release the petitioner on bail.
