ORDER

This Criminal Original Petition has been filed to direct the 1st and 2nd respondents to monitor and guide the investigation and direct the 3rd respondent to file a final report within a time frame limit as may be fixed by this Court in respect of Crime No.249 of 2012 based on the petitioner representation dated 06.09.2016.

2.The learned Additional Public Prosecutor appearing for the respondents submitted that in this case there are totally 28 accused, charge sheet in Crime No.249 of 2012 was filed as early as on 27.08.2012 and the same was returned for the reason that the bail bond and other connected papers are not available. He further submitted that the superior officers, https://hcservices.ecourts.gov.in/hcservices/

issued memo to the 3rd respondent Police, to rectify the defects in charge sheet and to file before the concerned jurisdictional Court. Thereafter, the charge sheet was filed against the accused persons for offence under Sections 147, 148, 341, 294(b), 324, 307 and 506(ii) of IPC and Section 3 of Tamil Nadu Public Property Damage and Loss Act. Now, the charge sheet is taken on file as PRC, shortly the case would be committed to the Court of Sessions.

3.In view of filing of charge sheet, nothing survives for adjudicating the petition and the same is, accordingly, dismissed. Considering the inordinate delay in filing of charge sheet, the learned Judicial Magistrate No.II, Hosur, is directed to take earnest steps, to complete the committal proceedings.
