The petitioner, who arrested and remanded to judicial custody on 15.02.2025, for an offences punishable under Section 8(c), 20(b)(ii),(C), 29(1) of NDPS Act, 1985, in Crime No.11 of 2025, registered on the file of the respondent, seeks bail.

2. The case of the prosecution is that 24 kg of ganja were seized from the joint possession of the petitioner and two co-accused and all were arrested on 15.02.2025.

3. The Learned Government Advocate (Crl.Side) appearing for the respondent states that on completion of investigation, final report been filed and the same taken on file in C.C.No.634 of 2025.

4. The 1st petitioner is before this Court seeking bail, stating that the accused were not possession of any contraband, much less commercial quantity. Even otherwise, the prosecution case is that, each one of them were possessing 8 kgs of Ganja, which means intermediate quantity and therefore, rigor of possessing commercial quantity will not arise. 2/4

5. However, the F.I.R and seizure memo indicates that all three persons were together having possession of the contraband seized and the manner in which it was identically packed in a trolley bag also indicates that, they have shared the common intention of possessing and distributing it for price.

6. In the given circumstances, the statutory embargo under Section 37(1)(b) of the NDPS Act is triggered and the petition for bail stands dismissed. 22.08.2025 bsm To,
