ORDER : The Court Made the following order :- The petitioner who was arrested and remanded to judicial custody on 28.09.2021 for the offences under Sections 457, 392, 397 and 109 of IPC, in Crime No.160 of 2021, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 07.08.2021 at about 3 a.m. two unknown persons trespassed into the house of the de facto complainant and robbed gold jewels worth about Rs.2,40,000/- and cash of Rs.4,82,000/- and two cell phones from the de facto complainant. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is no way connected with the alleged offence and he has been falsely implicated in this case and based on the confession of the co-accused and would further submit that the petitioner has been suffering incarceration for more than 60 days from 28.09.2021. 4.The learned Government Advocate (Crl. Side) would raise strong objection stating that the accused persons robbed gold jewels worth about Rs.2,40,000/- and cash of Rs.4,82,000/- and sofar, only 5 sovereigns of gold and cash of Rs.76,300/- have been recovered and that the investigation has not been completed. 5.On seeing the modes operandi and the fact that only a part of the stolen property has been recovered, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
