MARIA CLETE, J These petitions have been filed to condone the delay of 73 days in setting aside the abatement caused due to the death of the deceased sole appellant, to set aside the abatement caused due to the death of the deceased sole appellant and to bring on record the L.R.s of the deceased sole appellant respectively.

2.Heard Mr.I.Kowser Nissar, learned counsel for the appellant and Mr.R.Shivakumar for M/s.K.M.Vijayan Associates, learned counsel for the respondents who submits that he has got no serious objection in allowing these petitions.

3.Considering the reasons stated in the affidavits filed in support of these petitions which sets out the relationship of the proposed parties with the deceased and on being satisfied that the proposed parties represent the estate of the deceased within the meaning of Order XXII CPC, these petitions are allowed. Registry is directed to carry out necessary amendments in the cause title and list the main suit after eight weeks under the caption for "final hearing"
