Order of the Court was made by R.Suresh Kumar,J.

Heard learned counsel for both sides.

Perused the reasons stated in the affidavit filed in support of the petitions. Since due to communication gap and also some misunderstanding it seems that the learned counsel who represented before this Court earlier had represented that the appellants are no more, recording the same this Court by order dated 08.08.2023 disposed of these appeals as abated. However, they subsequently came to know that the appellants are very much surviving and the mistake committed by the learned counsel based on the wrong instruction or misconception has to be condoned. Therefore, it became necessitated for the appellants to file these petitions for restoration of the appeals.

2. Satisfied with the reasons stated by the learned counsel for the petitioners, this Court is inclined to allow these petitions. Accordingly, these petitions are ordered. Post the main appeals for hearing on 27.11.2023.
