The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the respondents to consider and pass orders on the petitioner's representation dated 21.11.2016 with regard to settlement of GPF, Group Insurance within a stipulated time.
2.Heard the arguments advanced on either side. 3.The case of the petitioner is that the petitioner's
husband joined as Helper in the respondent Board on 03.08.1972 and vide proceedings of the third respondent dated 18.06.2018, was removed from service for unauthorized absence within six months on three different spells. The petitioner's husband died on 23.07.1991. Thereafter, the petitioner came to know that amount towards GPF, Gratuity and Group Insurance were deducted from her husband's salary. Thereafter at her request the third respondent vide proceedings dated 25.09.1992 passed an order for payment of Rs.1,752/- from GPF and informed her that remaining 10% of GPF amount would be paid along with other dues at the time of closing the account. Since the same has not yet been paid, the petitioner made representation dated 21.11.2016 to the respondents requesting them to settle the amounts due to her husband. Since the same has not yet been considered has come forward with this writ petition.
4.The learned counsel appearing for the petitioner would submit that without going into the merits of the case, it would suffice, if this Court issues direction to the respondents to consider the petitioner's representation dated 21.11.2016 and to pass appropriate orders.
5.Considering the limited request made by the learned counsel appearing for the petitioner, I am inclined to issue direction to the respondents to consider the petitioner's representation dated 21.11.2016, on merits and in accordance with law and pass appropriate orders, within a period of twelve weeks from the date of receipt of a copy of this order. 6.The writ petition is accordingly disposed of.
