Respondent Prayer:- Criminal Original Petition filed under Section 482 Cr.P.C., praying to direct the respondent police not to harass the petitioner either by compelling the petitioner to vacate the agricultural lands in his possession in Survey No.55/2, Thadalan Village, Sirkali Taluk, Nagapattinam District or otherwise. ORDER

Charan Raj, the petitioner seeks a direction to the respondent police not to compel him to vacate the property and harass him.

2. According to the learned counsel for the petitioner, one Jagadheeswari is frequently giving him head ache. Petitioner has filed a suit in O.S.No.150 of 2015 as against the said Jagadheeswari in the Court of the District Munsif, Sirkali and it is pending. Enraged by that, now, she is setting respondent as against him.

3. On the other hand, the learned Additional Public Prosecutor submits that actually, the petitioner has lodged a complaint against the said Jagadheeswari and Chandrabose and C.S.R.No.336 of 2015 has been assigned and to enquire his complaint, he has been summoned, however, instead of responding to the said summons, he has filed this petition.

4. It is seen that there is on going dispute between Jagadheeswari and the petitioner with regard to a property matter. It is a civil dispute.

5. In the circumstances, the respondent shall not involve in a civil dispute, however, there is no bar for the respondent to proceed to enquire Charan Raj's petition in accordance with law. Petitioner should also co-operate with police. 6.Accordingly, this Criminal Original Petition is disposed of.
