This Criminal Original Petition has been filed to quash the First Information Report filed against the petitioners in Crime No.511 of 2016 for the offences under Sections 448, 323, 454, 380 and 506(II) IPC.
2. The crux of the allegation in the FIR is that the first accused, who is the son of the de facto complainant and his https://hcservices.ecourts.gov.in/hcservices/
friend broke open the house and taken away cash to the tune of Rs.4,50,000/-, 12 sovereigns of gold, RC book of vehicles and other bank documents and have also caused threat.
3. Though it is submitted by the learned counsel for the petitioners that the matter has been settled between the parties, learned counsel for the de facto complainant submits that he was not aware of the settlement and no papers have been served on him evidencing settlement.
4. This Court is of the view that since this is a dispute between father and son, if the matter is settled, it is open to the Investigating Officer to file a negative report.
5. With the above observation, this Criminal Original Petition is disposed of.
Consequently, the connected miscellaneous petitions are closed.
