ORDER

The prayer in the writ petition is for a Writ of Certiorari calling for the entire records relating to the impugned order passed by the respondent in his proceedings Na.Ka.C1/14531/2012, dated 19.10.2012 and quash the same.

The present writ petition is filed by the writ petitioner challenging the order of cancellation of Ration Card given to the petitioner on the ground that he had illegally included the name of one Padma Priya in the Ration Card as one of the members of his family. In order to obtain gas agency for the said Padma Priya in the place of residence of the petitioner, her name was included. On verification, it was found that the said Padma Priya was not a member of the petitioner's family. Therefore the authority had passed the impugned order dated 19.10.2012 cancelling the Ration Card granted to the petitioner in the address in which the petitioner is living.

3. When the matter is taken up for hearing, the learned counsel appearing for the petitioner submitted that the name of Padma Priya may be removed and the Ration Card may be re-issued to the petitioner, since the petitioner and his family are https://hcservices.ecourts.gov.in/hcservices/

living in the same address and cancellation of Ration Card was only on the ground of inclusion of the name of one Padma Priya illegally.

4. At this juncture the learned Special Government Pleader appearing for the respondent has no valid objection.

In the above said circumstances, while setting aside the order of the respondent in cancelling the Ration Card granted to the petitioner by proceedings dated 19.10.2012, considering the submission made by the learned counsel for the petitioner, the respondent is directed to re-issue the Ration Card to the petitioner by deleting the name of Padma Priya after verification as per the request made by the petitioner. It is also open to the petitioner to submit necessary representation along with the required documents once again to the respondent within a period of one week from the date of receipt of a copy of this order and the respondent shall consider the representation and re-issue the Ration Card to the petitioner on the basis of the particulars furnished by him within a period of four weeks thereafter.

6. With the above observation and direction this writ petition is allowed. No costs.
