This petition has been filed seeking to condone the delay of 1495 days in filing the appeal.

2.Heard the learned counsel for the petitioner.

3. Issue notice to the first respondent, returnable within four weeks.

4. Mr.J.Chandran, learned counsel takes notice for the second respondent and he would raise objections in allowing the petition. 5.The petitioner would aver that due to the injuries suffered on account of accident, he is not in a position to move anywhere without others help. He would further state that due to ill health and financial constrains, the delay of 1495 days occurred, which is not wanton.

6. The reasons assigned by the petitioner in the affidavit appear to be reasonable and acceptable. Therefore, this Court is inclined to allow this petition, subject to the condition that the interest for the delay period of 1495 days shall stand waived.
