Earlier, this court by an order dated 01.02.2023 granted interim anticipatory bail on condition that the petitioner shall deposit the first instalment of a sum of Rs.6,00,000/- (Rupees six lakhs only) to the credit of Crime No.32 of 2021 on or before 09.03.2023 and the second instalment falls on the next consecutive six weeks and after receiving another sum of Rs.6,00,000/-, the defacto complainant is directed to withdraw the amount as well as to withdraw the divorce petition filed by her. Further, the third instalment falls on the next consecutive six weeks and after receipt of the said amount, the defacto complainant is directed to withdraw the present F.I.R. and adjourned the matter for reporting compliance.

2. Today, when the matter taken up for hearing under the caption "For reporting compliance", the learned counsel for petitioner would submit that he unable to mobilise the fund and hence, he unable to deposit the amount as directed by this court. 1/3

3. Mr.R.Kishore Kumar, learned Government Advocate (Criminal side) for the respondent appeared and submitted that he has not complied the condition as directed by this court. Hence, he prayed to cancel the anticipatory bail granted to the petitioner.

4. Considering the facts and circumstances and also considering that the fact that the petitioner has not complied any of the conditions imposed by this court, this Court is inclined to cancel the anticipatory bail granted to the petitioners. Accordingly, this Criminal Original Petition is dismissed and the order passed by this court in Crl.O.P.No.23406 of 2022 dated 01.02.2023 is cancelled. 17.08.2023 rpp 2/3
