Respondent(s) PRAYER To call for the records relating to the impugned order of the respondent in Ma.A.8.Po.Su.Thu.Na.Ka.No.1893/2025 dated 01.07.2025 and quash the same and direct the respondent to enter the name of the father of the petitioner's deceased father Mr.K.K.Narayanan as Sankaran Nair in the Births and Deaths Register maintained by him in accordance with Section 15 of Registration of Births and Deaths Act, 1969 and issue appropriate certificate in accordance with the said alternation to the petitioner.

ORDER

This writ petition has been filed challenging the impugned proceedings of the respondent dated 01.07.2025 and for a consequential direction to the respondent to mention the name of the deceased Mr.K.K.Narayanan's father as Mr.Sankaran Nair instead of Mr.Veerasamy.

2. Heard Mr.P.Mohanraj, learned counsel for the petitioner and Mrs.Aswini Devi, learned Standing Counsel appearing on behalf of the respondent.

3. The respondent has issued the impugned proceedings dated 01.07.2025, rejecting the claim made by the petitioner on the ground that no such correction is permissible under the provisions of the Registration of Births and Deaths Act, 1969.

In the considered view of this Court, Section 15 of the Act read with Rule 11 of the Tamil Nadu Registration of Births and Deaths Rules, 2000 clearly gives the power to the respondents to make necessary correction, since any improper entry made in the death certificate can also be corrected apart from correcting any clerical mistakes.

5. This Court also finds that there are documents to establish the correct name of the father of the deceased Mr.K.K.Narayanan and which is Mr.Sankaran Nair. Hence, the impugned rejection order passed by the respondent dated 01.05.2025, is quashed and there shall be a direction to the respondent to entertain the application of the writ petitioner, conduct an inquiry and incorporate the correction in the death certificate. This process shall be completed by the respondent within a period of six (6) weeks from the date of receipt of a copy of this order.
