O R D E R

The Contempt Petition has been filed to punish the 1st respondent for willful disobedience of the order of this Court in W.P.No.18035 of 2021 dated 31.08.2021.

2.When the matter was taken up for hearing, the learned Standing Counsel appearing on behalf of the 1st respondent produced the proceedings of the Assistant Executive Engineer dated 10.05.2024. The Assistant Executive Engineer has come to a conclusion that the genuineness of the documents produced by both the sides cannot be decided by the 1st respondent. He has to workout the remedy before the concerned Authority / Court.

3.The decision taken by the 1st respondent cannot be faulted, since, the 1st respondent cannot decide on the genuineness of the documents. Therefore, the petitioner has to necessarily give a complaint in this regard either to the District Registrar or must workout the remedy before the Civil Court. Based on the final decision, the 1st respondent will act upon the same.
