ORDER

1. This is an application filed by the petitioner to condone the delay of 247 days in representing the above C.S.

2. The petitioner stated that he is the plaintiff and filed this suit against the defendant for recovery of money. While so, it was directed by the Registry to invoke Sec.12 (a) of Commercial Court Act. Thus, the matter referred to Legal Services Authorities for Pre-Litigation Mediation. Thus, there is a delay.

3. Heard the petitioner. Records perused. The petitioner alleged that the delay occurred due to Mediation as per direction of the Registry. This petitioner filed an affidavit to that effect. Thus, the reason is sufficient to allow the application. Anyhow, while allowing the application write to raise any question of limitation as defence by the respondent ought to be considered. Hence, this application is decided as below. In the result, this application is allowed reserving a right to the respondent to raise any defence of limitation with regard to this application.
