ORDER

This writ petition has been filed challenging the impugned election notification dated 18.07.2025 issued by the 2 nd respondent in violation of the earlier valid election process initiated on 28.04.2025 and for a consequential direction to forbear the 2 nd respondent from modifying, updating, amending or approving any change in the official records concerning the electoral roll, office bearers or meeting resolutions of the 3 rd respondent society and further appoint a committee of Administration by this Court to take over the administration of the rd respondent society and to conduct free, fair and transparent elections in accordance with the election notification dated 28.04.2025. 2.

Heard Mr.I.Arockia Selvaraj, learned counsel for the petitioner and Ms.N.S.Tanvi, learned Standing counsel for 1 st respondent and Mr.Stalin Abhimanyu, learned Additional Government Pleader for 2 nd respondent.

The election dispute is sought to be raised in the present writ

petition. This Court has consistently held that insofar as the election dispute is concerned, it involves disputed questions of fact and this Court while exercising its jurisdiction under Article 226 of Constitution of India, does not go into the said disputed question of facts. The correct procedure for the petitioner is to approach the concerned civil Court and question the election notification or the election process initiated. Except giving this clarity, no further orders can be passed in this writ petition.
