O R D E R
This petition has been filed seeking for transfer of investigation in Crime No.221 of 2023 pending on the file of 3rd respondent police to some other investigation agency.
2.The learned Additional Public Prosecutor on instructions submitted that the investigation has been completed and the final report has also been filed before the learned Metropolitan Magistrate-IV, Saidapet on 25.08.2023. A copy of the final report was also placed before this Court and it is seen that the final report has been filed for offence under Sections 279, 304A of IPC and Sections 134(a), 134(b) and 187 of the Motor Vehicles Act. The learned Additional Public Prosecutor submitted that the final report is yet to be taken on file. 3.In view of the above, this criminal original petition is disposed of with a direction to the learned Metropolitan Magistrate-IV, Saidapet to act upon the final 2/4
report filed by the respondent police, within a period of four weeks from the date of receipt of copy of this order. After the final report is taken on file, it is left open to the petitioner/defacto complainant to apply for the certified copy of the final report and if the petitioner is not satisfied with the same, it is left of open to the petitioner to workout his remedy in the manner known to law. Consequently, connected miscellaneous petition is closed.
