ORDER : The Court Made the following order :- The petitioner who was arrested and remanded to judicial custody on 17.09.2021 for the offences under Section Man Missing- Non Act @ 120B, 147, 148, 201, 302 IPC, in Crime No.539 of 2021, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 14.09.2021, the de facto complainant's son had not returned to home who had gone out for searching job. Hence, the de facto complainant lodged a complaint. Initially, the case was registered under "Man Missing". On 15.09.2021, the Village Administrative Officer informed the police about the presence of a human body without head and hands. Later on enquiry, it was found that it was the son of the defacto complainant and hence the case was altered as stated above. https://hcservices.ecourts.gov.in/hcservices/

3.The learned counsel for the petitioner would submit that the petitioner is a practicing Advocate and he is no way connected with the alleged offence and he has been falsely implicated in this case based on the confession statement given by A1. He would further submit that the petitioner has been suffering incarceration for more than 70 days from 17.09.2021 and hence, he would pray for grant of bail to the petitioner.

4.The learned Government Advocate (Crl. Side) would raise objection stating that it is a case of retaliation murder. Insofar as the petitioner is concerned, he is the close relative of A1 and he is the one who given plan to commit the offence and that the case needs a detailed enquiry.

5.On seeing the grave nature of allegation levelled against the petitioner and the modes operandi, this court is not inclined to grant bail to the petitioner, Accordingly, this Criminal Original Petition is dismissed.
