Crl.O.P.No.23681 of 2022 G.K.ILANTHIRAIYAN, J.

The petitioner, who was arrested and remanded to judicial custody on 13.04.2022 for the offences punishable under Section 5(1) read with 6 of POCSO Act in crime No.322 of 2022 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 10.04.2022, the daughter of the de-facto complainant was found missing. Hence the complaint.

3. The learned Additional Public Prosecutor would submit that on the pretext of false marriage, the petitioner had committed penetrative sexual assault on the victim girl aged about 16 years. He would further submit that earlier, the petitioner filed a bail petition before this Court in Crl.O.P.No.20662 of 2022 and the same was dismissed on 30.08.2022. Hence, he vehemently opposed to grant of bail to the petitioner.

4. Considering the nature of offence committed by the petitioner as against the minor victim girl and this Court had dismissed the earlier bail

petition filed by the petitioner and that there is no change of circumstances, this Court is not inclined to grant bail to the petitioner. Accordingly, the criminal original petition is dismissed.
