CRIME NO.407 OF 2021 Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to relax the condition imposed by this Hon`ble Court in Crl.MP.No.9732 of 2021 in Crl.OP.No.14751 of 2021 dated 24.09.2021 that the petitioner shall appear before the respodent police, every Monday at 10.30 a.m., until the investigation is completed and charge sheet is filed and thereafter, shall appear before the concerned trial court on each and every date of hearing.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.KARAN AND UDAY, Advocate for the Petitioner and of MR.A.GOKULAKRISHNAN, Additional public Prosecutor on behalf of the Respondent the court made the following order:- Vide Order dated 24.09.2021, this Court had modified the condition for relaxation as imposed by the petitioner. This petition has been filed by the petitioner seeking further relaxation of the conditions.

2. Learned Additional Public Prosecutor appearing for the respondent submits that the charge sheet has not been filed. However, it is submitted that the petitioner is complying with the conditions. https://hcservices.ecourts.gov.in/hcservices/

3. In view of the above submission, considering that this Court by it order dated 24.09.2021, modified the condition as imposed by the petitioner that to appear before the respondent police on every Monday at 10.30 a.m till filing of the charge sheet. Since, the charge sheet has not been filed, this Court is of the considered view that the prayer as sought for by the petitioner could not be acceded to.
