The present miscellaneous petition has been filed seeking to condone the delay of 103 days in filing the said appeal against the order passed by the learned Judicial Magistrate, No.I, Thirupattur, Thirupattur District in S.T.C.No.88 of 2016 dated 03.03.2023.

2. Mr.C.Johnson, learned counsel appearing for the respondent vehemently opposed for allowing this petition.

3. Having satisfied with the reasons stated in the accompanying affidavit filed in support of this petition, this petition stands allowed.

4. Registry is directed to number the Criminal Appeal, if the papers are otherwise in order and list the same for admission.
